The typical steps in our settlement agreement service are as follows:

 

  1. Contact us for an initial conversation to see how we can help. 

     

  2. Once you are happy to proceed, we can arrange a convenient time to go through your settlement agreement with you.

     

  3. In accordance with your instructions we can negotiate the settlement agreement package and/or terms on your behalf.

     

  4. Once you are happy to sign the settlement agreement, we will arrange for this to be sent to your employer together with our adviser's certificate. 

     

  5. The final step will be receiving the employer's signed version of your settlement agreement and for you to await payment of your settlement sum.

Settlement Agreement FAQs

What is a settlement agreement?

 

A settlement agreement is a legal document typically between an employee and their employer. Usually there will be obligations under the agreement on the employee and on the employer. By signing the settlement agreement, the employee is agreeing to not bring claims (or withdraw existing claims) against their employer usually in exchange for money paid by the employer. 

 

How long does it take to finalise a settlement agreement?

 

If you do not require any negotiation of the settlement agreement, the process can generally be finalised within 24-48 hours. 

 

When is a settlement agreement legally binding?

 

A settlement agreement is legally binding, once both the employee and employer have signed the settlement agreement. 

 

When will I get payment from a settlement agreement?

 

When you will receive payment from a settlement agreement should be specified in the terms of the settlement agreement. Usually this will be specified as a number of days after your employer has received your signed settlement agreement (and our adviser's certificate) or after the Termination Date if that date is later. 

 

Do I have to agree to sign a settlement agreement?

 

No, there is no obligation to sign a settlement agreement from your employer. You should only sign the settlement agreement if you are happy to do so. 

 

Do I need a Solicitor for a settlement agreement?

 

In order for an employment settlement agreement to be binding, the employee must receive advice on the terms and effect of the settlement agreement and its effect on the ability to bring claims. This advice is usually provided by an Employment Law Solicitor. 

 

Who pays the Solicitor's Legal Fees for the settlement agreement?

 

Usually under the terms of the settlement agreement, the employer will agree to pay a contribution towards an employee's legal fees. 

 

How long does it take to negotiate a settlement agreement?

 

How long negotiation of a settlement agreement takes varies on a case by case basis, but the timescales are usually impacted by the extent of changes being negotiated and the speed of response by both parties. 

 

Will I get a reference as part of a settlement agreement?

 

Often a settlement agreement will include a reference. If it does not, this can be requested as part of the negotiation of the settlement agreement.
